RAINER FRUIT COMPANY 2023 GOLDEN TICKET SWEEPSTAKES OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. The Rainier Fruit Company 2023 Golden Ticket Sweepstakes Official Rules (the “Sweepstakes”) will commence at 12:00:00 A.M. Eastern Standard Time November 15, 2023 and end at 11:59:59 P.M. Eastern Standard Time December 15, 2023 (the “Sweepstakes Period”). The Sponsor of this promotion is Rainier Fruit Company, P.O. BOX 189, Selah, WA 98942 (“Rainier” or “Sponsor”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Sweepstakes.
ELIGIBILITY: Open only to legal residents of the 50 contiguous U.S. states and the District of Columbia who are 18 years or older at the time of entry. Void elsewhere and where prohibited. Sponsor, and its parent, subsidiary and affiliate companies, along with each of their respective officers, directors, executives, and employees (collectively, the “Released Entities”), and each of the immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter.
HOW TO ENTER: Participants may enter the Sweepstakes by scanning the QR code displayed on the Golden Ticket affixed to a package of Sponsor’s fruit products at a HEB store in Texas during the Sweepstakes Period. Once QR code is scanned, Participant must provide all requested information (name, phone number, email, address, etc.) and submit the form to be considered an “Entrant”.
As an alternative method of entry, Participants may visit the webpage http://www.rainerfruit.com/trip, provide all requested information (name, phone number, email, address, etc.), and submit the form during the Sweepstakes Period to be considered an “Entrant”.
Participants may only enter the Sweepstakes one (1) time, regardless of method of entry.
You may not enter more times by using multiple email addresses, identities, accounts, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.
Entries will not be deemed valid for the Sweepstakes unless they: (a) meet the requirements set forth above; (b) comply with the rules of the Sweepstakes; (c) do not contain obscene, offensive or objectionable imagery or language, or communicate messages inconsistent with the positive images to which Sponsor wishes to associate; and (d) do not infringe, misappropriate or violate the rights of any third party. Entries that do not include any required disclosures or that are not received by Sponsor for any reason will not be eligible and will be disqualified. Multiple participants are not permitted to share the same email address or social media account. Sponsor is not responsible for lost, misdirected, false, corrupted, illegible or late entries. Sponsor shall have the sole discretion to determine the validity of an Entry.
All potential winners are subject to verification before any prize will be awarded. Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and Administrator reserve the right to verify the eligibility of winners. In the event of a dispute concerning the identity of a participant, the entry will be declared to have been made by the registered account holder of the social media account used for entry, but only if that person meets all other eligibility criteria, otherwise the entry may be disqualified, and any potential prize won will be forfeited in Sponsor’s sole discretion.
PRIZE SELECTION: Following the conclusion of the Sweepstakes Period, or about December 15, 2023, one (1) potential winner will be selected at random by Sponsor from among all eligible entries to receive the Grand Prize described below. The odds of winning the prizes depend on the number of eligible entries received during the Sweepstakes Period. The potential winner will be notified via phone, email, and or text no later than December 20, 2023. The potential winner must respond to Sponsor’s notification within five (5) days of the original contact attempt or will forfeit the prize. Prior to being confirmed as the Winner, potential winner will be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within ten (10) calendar days of prize notification. Refusal to do so will result in forfeiture of the prize. If potential winner cannot be contacted within ten (10) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any potential winner fails to return his/her winner documents within the time set forth above or otherwise rejects his/her prize, or in the event of noncompliance with these Sweepstakes Official Rules, such eligible winner may forfeit such prize and an alternate eligible winner may be selected from all remaining eligible entries, time permitting. Upon prize forfeiture, no compensation will be given. Potential winner must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.
PRIZES:
Grand Prize: One (1) Winner will receive a trip to Seattle, Washington for two (2) people (Winner and one guest), including round-trip economy airfare and lodging, to be determined at Sponsor’s sole discretion (the “Prize”). Total Prize ARV: $2,500.00.
Winner must redeem the Prize before December 31, 2024. Sponsor may reschedule and/or relocate the Prize location in Sponsor’s sole discretion. Once date of Prize is confirmed by Sponsor, Winner and guest must be available to travel on the confirmed dates. If Winners and/or guests are not able to travel on the confirmed dates, they may forfeit the Prize in Sponsor’s sole discretion. If in the judgment of the Sponsor, air travel is not required due to Winner’s proximity to the trip destination, ground transportation will be substituted for roundtrip air travel at the Sponsor’s sole and absolute discretion.
All guests must be 18 or older and legal U.S. residents currently residing in the 50 United States and the District of Columbia. If guest is under 18, the Winner traveling with that guest must be their legal parent or guardian. Any guests are bound by these Official Rules. All additional expenses, including transportation to and from the airport or incidental travel costs not expressly stated in the package description above, including but not limited to, meals, personal charges at lodging, airport parking, security fees, taxes, gratuities or other expenses or incidentals are the responsibility solely of Winners. Winners and their guests must possess all necessary documentation required for air travel (e.g., valid photo identification). No warranty or guarantee will be given by Sponsor with respect to the prize. Sponsor is not responsible if air travel or hotel booking is changed, canceled, or postponed or if travel to Event location is made unavailable by circumstances beyond Sponsor’s control. Selection of activity location, airline, seating, and lodging is selected by Sponsor in its sole discretion. ALL PRIZES ARE AWARDED “AS IS” AND THE SPONSOR DOES NOT MAKE (AND IS NOT RESPONSIBLE FOR) ANY REPRESENTATIONS, GUARANTEES, OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO ANY PRIZE (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.
Winner is solely responsible for following any terms, conditions, or restrictions of any and all transportation companies, hotels, and events and activities hosts. Winner recognizes Sponsor’s right to terminate the right to receive a prize, including ending a trip early, if Winner (or Winner’s guests, if applicable) engage in behavior that is inappropriate, illegal, threatening, inappropriate, defamatory or disparaging.
Prizes are not negotiable with the Winner. Prizes are non-transferable, and no substitutions are allowed except by Sponsor who may award a prize for one of equal or greater value for any reason. If a prize is not claimed within the designated time period, an alternate potential winner will be drawn from all remaining eligible entries.
Winner is solely responsible for all applicable federal, state and local taxes and fees, including income or local personal property taxes, insurance, licensing, registration and title fees arising out of the receipt and use of the prizes. Any difference between the stated estimated value of a prize and its actual value will not be awarded.
SPONSOR’S RIGHTS. Participation in Sweepstakes constitutes Entrant’s grant to Sponsor, Administrator and their partners and designees, the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to Winner’s entry submission, name, address (city and state/province/territory), likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by Entrant regarding the Sweepstakes or the prize(s) for advertising and promotional purposes without limitation, in any media, worldwide, without notice or additional compensation or consent, except where prohibited by law.
If an Entrant chooses to submit or post any media content (including to but not limited to photographs, videos, recordings) in connection with this Sweepstakes, that Entrant grants to Sponsor, Administrator and their partners and designees, a worldwide, royalty-free, perpetual, non-exclusive right and license to use, reproduce, copy, distribute, and display each submitted Entry and any part thereof, in any media, and the right to use, copy, modify, edit, and create derivative works therefrom, and agrees to execute documents confirming such right and license at Sponsor’s reasonable request. By entering, you understand that your Entry will be reviewed by Sponsor and may be posted online to a gallery or featured in Sponsor’s social media channels or other advertising, in Sponsor’s sole discretion, to be viewed by members of the general public. All Entries that meet the Sweepstakes eligibility requirements will be entered for a chance to win, regardless of whether they are featured or posted by Sponsor. By entering, each entrant warrants and represents that his/her Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances.
GENERAL CONDITIONS. By participating in this Sweepstakes, each Entrant represents that there is no legal or contractual restriction barring participation, including, without limitation, any restriction from participant’s employer or company. Entrants agree to release, indemnify and hold harmless the Released Entities and the Social Media Platforms from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on copyright, trademark, publicity rights, defamation or invasion of privacy and merchandise delivery.
In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the e-mail address used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or is the owner of the social media account used for the entry at issue. Any potential winner may be requested to provide proof that such winner is the authorized account holder of the e-mail address associated with the winning entry or other proof of identity. The Released Entities are not responsible for technical, hardware, software, network or other communications malfunctions, errors or failures of any kind, lost, interrupted or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, winner(s) will be selected from all eligible participants prior to and/or after (if appropriate) the action taken. Entrants who do not comply with these Official Rules or attempt to interfere with this Sweepstakes in any way shall be disqualified. Released Entities are not responsible for any typographical, display, input, or other error in any Sweepstakes materials, or for any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won.
IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE AND/OR THE SWEEPSTAKES, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
PRIVACY: Information collected from Entrants is subject to Sponsor’s Privacy Policy which can be found at https://cm6.4bc.mwp.accessdomain.com/privacy-policy. By entering this Sweepstakes, you agree to the use of your personal information as described in the above Privacy Policy.
WINNERS: For a list of winners, send a stamped, self-addressed envelope by January 31, 2024 to Sponsor at the following mailing address: Rainier Fruit Company, P.O. BOX 189, Selah, WA 98942.
